In my book, “Misplaced Trust,” I wrote frequenty about heirs being disinherited. They were all clients and this is the first time I have known someone personally. The father of a person I know recently passed. It has come to light that my friend, his brother and sister were disinherited. What is sad is that the father had a great deal of land that could have benefited his brother and sister. Instead, however, the man chose his deceased daughter’s ex-husband. This was shocking. He did, leave something small to a half brother of my friend. The half brother is four months younger than him so apparently he was a busy man over fifty years ago. The family are nice people. They never did harm to the dad to the best of my knowledge so it seems extremely unfair and unjust. My friend is really upset but he will not challenge the documents. I would have told him to claim undue influence. Here is the worst part. While my friend and his siblings were at the funeral home, the ex brother-in-law arrived and asked them to pay for the funeral. What type of person is he really? In my book, undue infuence did occur on numerous occasions. However, there were other circumstances where the children were in jail, on drugs, and when possibly robbed their parents. In one of my stories a daughter cleaned out her mother’s bank account, and then forged her name on an auto loan. As the daughter was so horrible as a person and with money, the vehicle was repossessed. The mother did disinherit her with the little she had left. The daughter had actually tried to steal the home but she failed. As we have seen in the news, that is now a common occurance. The parent is usually left homeless and penniless.
