
Estate plans are important to individuals who own property or have large sums of money in bank accouts. Besides writing this is what I do everyday. Many people fail to realize that there are items that should NOT go in your estate plan or living trust. For example, many people believe that putting their insurance policies is safe. By making the trust the beneficiary it is a nightmare not only for the successor trustee but the eneficiaries. You are much better off naming the beneficiaries. If the insurance cannot find the address of a specific beneficiary, don’t worry they will ask the other individuals or do an actual search. I know that is what happened to me when I was a small beneficiary of an insurance policy. Also if you have annuities do not include them in the trust as it can also be complicated to distribute. Many people believe in putting their vehicles into their trust. For some states it is not complicated but for a number of them it is a lot of work to transfer it out of the trust particularly if you wish to sell it. This also includes, boats, golf vehicles, motorcycles and any other motorized vehicles. Do not include bank accounts, business accounts and other assets that are too complicated to change after you pass. Do put your home and other real estate in your estate plan. It is much easier to deal with in all states. Do not include out of the country assets as each country has their own laws. Do you have an estate plan? This was not a topic for the Good Gus series.
