There was an article today about settling an estate. It said it could take up to nine hunded hours. Here is the thing, if you have a trust and if you use the right person not only will it cost much less but also take less time.When I became a paralegal, I was trained very quickly in trust administration or settling an estate. Anyone who has a Will should obtain a living trust. It comes with important documents, at least that is what we do, that you can use now such as a Durable Power of Attorney which is for money. This can be used by your husband or partner if, for example, you injure your hand and can no longer write checks or do banking online. It also has an Advanced Health Care Directive which comes in handy if you are suddenly sick or in an accident. Your family will know exactly what to do and what your wishes are if you are unconscious. The Will can be useful if you pass and forget to put a smal property or amount of money in your trust. Most states, except for California, have a very low probate rate. For ecample if you had thirty thousand dollars or thirty-one thousand Euros, other than Caifornia you would be forced to go to probate. Rates vary from state to state but it is not money you wish to give up for taxes for your heirs. We also give a document entitled Schedule A. It lists your properties and it is handy if you need assistance with a Will for your attorney to file a motion to avoid probate. If you put your home in your trust and then take it out to refinance always remember to put it back. If you forget, there is a specific motion along with a few of your documents that an attorney can file to put it back in your trust.
